These Terms of Service (“Terms”) govern the use of the platform Socializzami, operated by Noventra S.r.l. (“Company”, “we”, “us”). By accessing or using the Platform, the user (“User” or “Customer”) agrees to be bound by these Terms.
1. Acceptance of Terms
By creating an account, placing an order, or using any service, the User expressly acknowledges and accepts these Terms. If the User does not agree, they must immediately cease use of the Platform.
2. Service Description
Socializzami provides digital services aimed at enhancing the visibility and perceived presence of social media accounts. The services are provided “as is” and “as available”, without any guarantee of specific outcomes beyond what is explicitly stated.
3. No Guarantee of Results
The Company does not guarantee:
- engagement (likes, comments, interactions)
- retention or permanence of followers
- authenticity or activity level of delivered accounts
- compliance outcomes on third-party platforms
The User acknowledges that services are limited to delivery of the purchased quantity only.
4. Third-Party Platforms
The User agrees to use the Platform in compliance with the terms of:
- Twitter/X
- YouTube
- or any other third-party platform
The Company has no control over third-party platforms and shall not be liable for:
- account suspension
- content removal
- algorithmic changes
- service interruptions
5. User Obligations
The User agrees that they will:
- provide accurate and lawful information
- not upload unlawful, offensive, or prohibited content
- not use the Platform for illegal activities
- ensure that social accounts are public where required
Failure to comply may result in immediate suspension or termination without notice.
6. Orders and Delivery
- All orders are final and non-cancellable once placed
- Delivery times are estimates only and not guaranteed
- The Company reserves the right to modify service execution methods if necessary
Delays or partial delivery do not constitute a breach of contract.
7. Pricing and Modifications
Prices and service conditions may be modified at any time without prior notice.
Such changes do not affect orders already completed.
8. Refund Policy
All payments are final and non-refundable, except where explicitly required by applicable law.
In cases where a service cannot be delivered, the Company may, at its sole discretion:
- issue a credit to the User’s account
- provide a replacement service
Refunds to the original payment method are excluded unless legally required.
9. Chargebacks and Disputes
By completing a payment, the User agrees not to initiate chargebacks or disputes without prior contact. In case of unjustified chargeback, the Company reserves the right to:
- suspend or terminate the account
- recover delivered services
- take legal action
10. Limitation of Liability
To the maximum extent permitted by law:
- The Company shall not be liable for any indirect, incidental, or consequential damages
- The Company shall not be liable for loss of profits, revenue, or business opportunities
- Total liability shall not exceed the amount paid by the User in the preceding 30 days
Nothing in these Terms excludes liability where such exclusion is not permitted by law.
11. Disclaimer
Services are provided without warranties of any kind, express or implied. The Company does not guarantee uninterrupted or error-free operation.
12. Fraud and Abuse
Any fraudulent activity, including but not limited to:
- use of stolen payment methods
- unauthorized transactions
will result in immediate termination and possible legal action.
13. Suspension and Termination
The Company reserves the right to suspend or terminate accounts at any time, with or without notice, in case of:
- breach of these Terms
- suspected abuse or fraud
- legal or regulatory requirements
14. Modifications to Terms
The Company reserves the right to update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by Italian law. Any dispute shall be subject to the exclusive jurisdiction of the Court of Naples, Italy.
16. Final Provisions
If any provision is found invalid, the remaining provisions shall remain in full force.
